Sedition law in India

HISTORY OF SEDITION LAW IN INDIA. 

When Britishers occupied us they introduced INDIAN PENAL CODE to restrict us by their own laws and rules. 

ABOUT INDIAN PENAL CODE LITTLE INFO

Sedition law was enacted in the 17th century when lawmakers believed that “only good opinions of the government should survive as bad opinions were detrimental to government and monarchy”.

Indian penal code is an official criminal code of India it is a comprehensive code intended to cover all substantive aspects of criminal law the code was drafted on the recommendations of the first law commission of India established in 1834 under the Charter act of 1833 under the chairmanship of Lord Thompson Bebington Macaulay. it came into force in 1862. 

The objective of this act is to provide a General criminal code for India; it was divided into 23 chapters and 511 sections. 

WHY SEDITION LAW INTRODUCED? 

The British government in India feared that Muslim preachers in the Indian subcontinent would wage a war against the Wahabi Moment by British the need was felt for Such law through India.

In the past to get rid of British rule our freedom fighters used to give lectures through their writing poets, books, and issuing propaganda to have a nation of our own. 

So, they thought if we leave Indian’s like this, then no longer they will rule India, to avoid this they have introduced sedition law.


They used this law solely to suppress the people who raise their voices. And for the establishment of an own nation. 

Section 124A of the Indian penal code which deals with sedition was drafted by Thomas Babington Macaulay and included in IPC in 1870.

Let's see some prominent cases in the independent era, 

When Britishers were ruling us they used this section to suppress and activate in favor of national Independence including Bal Gangadhar Tilak, Mahatma Gandhi, and both of them were found guilty and imprisoned. 

MAHATMA GANDHI ON SEDITION LAW AS FOLLOWS,,, 

“The Prince among the political sections of IPC designed to suppress the liberty of a citizen”.

JAWAHARLAL NEHRU ON SEDITION LAW AS FOLLOWS,,, 

“The provision was Obnoxious and highly Objectionable and sooner we get rid of the better”

This is a tool for Britishers to suppress the Indians who raise the ideas of nationalism. 

WHAT IS ACTUALLY IS SEDITION LAW IS

According to Section 124 of the Indian penal code states that 

“Whoever, by words either spoken or written or by sign’s or by visible, representation or otherwise brings or attempts or excite disaffection towards the government established by law in India shall be punishable with imprisonment for life to which a fine may be added and that imprisonment will be up to three years”. 

IPC STATES SEDITION LAW AS FOLLOWS

That means if any person expresses any form of dissatisfaction towards a government and if the government thinks such expression of dissatisfaction is a threat to the sovereignty and authority of the government then he or she may be punished a prison term or fine may be imposed. 


Sedition systematically destroys the soul of Gandhian philosophy that is right to dissent.

DO EVERYTHING WE CURSE AGAINST GOVERNMENT IS SEDITION

No, even if the words are considered harmful to the government if it doesn’t Ignite violence or disaffection then it is not seditious. 

In simple terms, we can severely criticize the government policies, its laws, and its flaws, this is not seditious. 

It should not incite the people to destroy the peace, tranquility, and order of the nation. 

It somewhat will suppress what every citizen ought to do in a democracy like raise questions, debate, disagree, and challenge the Government’s decision

SEDITION IN INDEPENDENT INDIA, 

After independence, India retain Section 124 because the new government of free India was threatened 

Right-wing experiment as well as by left-wing extremist

The challenges of setting millions of partition refugees

Internal conflicts will raise nationalism feelings. 

So, due to these concerns, they still continued in IPC.

OUR CONCERN IS NOW IS SEDITION LAW REALLY NEEDED FOR US 

In the past it was used by Britishers to restrict our freedom of speech, now is this necessary for us! 

At present our country is a well-shaped developing country, so now by using this tool restricting our freedom of speech is not a good sign for our country. 

The country which introduced(UK) sedition law has removed it in their own country. 

IPC is drafted by Britishers so we need to make amendments according to time and we need to update it from time to time. 

Even if we have sedition or not we should not give statements that affect the country honor. There should be limitations.
