IS IT THE RIGHT TIME TO ADOPT UNIFORM CIVIL CODE IN INDIA ?

India is a secular country, Being a secular country there is no need to treat all religions equally.
Being secular comes value-added when every all religions, comes under one umbrella of dealing the same law for everyone.
In the coming days, BJP is planning to adopt UNIFORM CIVIL CODE for the whole of India. Now let’s have a detailed look at it.
WHAT IS A UNIFORM CIVIL CODE?
The Uniform civil code is a code in India to formulate and implement personal laws on all citizens of India regardless of their religion.
In simple words, uniform civil code refers to the idea of a single law applicable to all citizens of India in terms of personal matters of marriage, customs, custody adoption divorce, and many more.
The main objective of the amendment of Article 44 of directive principles of state policy, in the Indian constitution that we shouldn't maintain any sort of discrimination against vulnerable groups across the length and breadth of our country.
Article 44 of the Indian Constitution States that,
" The states should endeavour to be secular for the citizens of a UCC throughout the territory of India “.
Article 44 of the Indian Constitution is responsible for Directive principles of state policies which guide whether the state shall endeavor to provide for it within a Uniform Civil Code.
In the long back history in 1840 on the basis of the Lex loci report framed uniform laws for crimes and evidence, but for personal laws, Hindu and Muslims are left intentionally. Because they know Indians are too sentimental in religious customs.
History of UCC
There were many bills that were passed to codify in the form of Hindu Marriage Act 1955, The Hindu Succession Act 1956, The Hindu minority and guardianship Act 1956, and the Hindu adoption and maintenance act 1956 are collectively known as Hindu codes.
In 1954 special Marriage Act allowed any citizen to marry outside the domain of any special religious personal laws. But this stereotype is not even broken. Which is just restricted to the paper document.
That means these covers all the different religious denominations of Hindu which allow no diversity and inheritance of women, made cost irrelevant to marriage.
Present status of UCC
In the scenario, UCC was proposed twice in 2019 November and March 2020 but was withdrawn soon without introduction in Parliament due to the issue being a very sensitive and complicated issue.
Goa was separated from the British and it was obtained by the Portuguese and hence it became a state with Uniform Civil Code. In India, it’s the only state to have it.
The hurdle to the UCC bill
Article 25 of the Constitution, provides for the freedom to practice and follow religion, which adds value to Article 14 which is the right to equality. Pressure from society and from religious superstitions.
These are making it not to be implemented.
Article 29-30 of the constitution guarantees all people of India the right to conserve their culture and script to run their own educational institution. In other words, they have their own rights to follow their own customs and traditions.
Article 25-28 of the Indian constitution guarantees religious freedom to all citizens of India. This comes under the amendment of Article 44 of the Indian constitution which articulates to secure a uniform civil code for citizens throughout the whole of India.
Benefits by adopting UCC
Ucc helps to crop the national integration by removing disparities among loyalties between people to the law.
Different religious communities have different personal laws which leave politicization of informed Civil Code debates.
By having it we will precisely save manpower, infrastructure, and many more in dealing with religious laws.
On the other hand, some say that it's not the right time to adopt the Uniform Civil Code throughout India but India is well fitted in the existing glass there is no need to implement it. In the future, there should be some action. That should be taken on at that time.
